The update of the General Competition Goals Plan (Plano Geral de Metas de Competição – “PGMC”), the consolidation of service rules, and the expansion of initiatives focused on cybersecurity, artificial intelligence, and data centers were among the key innovations in the regulatory environment.
For 2026, the outlook is equally dynamic
The regulatory agenda is expected to feature a review of the use of radiofrequency spectrum, a redefinition of the rules applicable to the Conditioned Access Service (Serviço de Acesso Condicionado – “SeAC” or “Pay-TV”) in light of advances in new audiovisual content offerings, progress in discussions around the “cost-sharing of infrastructure capacity” (also referred to as fair share) due to the massive use of telecommunications networks by big techs, an update to the guidelines for classifying priority projects for the issuance of bonds (debentures), and the long-awaited outcome of pole-sharing regulation between ANATEL and the Brazilian Electric Power Agency (Agência Nacional de Energia Elétrica – “ANEEL”). In terms of opportunities, new radiofrequency auctions stand out, especially in the 700 MHz, 6 GHz, and other strategic bands.
